Progress in Trademark Cancellation Defense Reviews

The China National Intellectual Property Administration (CNIPA) has been increasingly stringent in reviewing evidence of trademark use in defense cases, further emphasizing the obligation of trademark use to address the issue of "emphasizing registration over use." This change imposes higher standards on the burden of proof for trademark registrants. Therefore, trademark holders must actively use their registered trademarks while also preserving relevant evidence and actively defending against non-use cancellations to protect their rights.
